1. Agreement to Terms
By accessing or using the DrivenSystem website (drivensystem.net) or any of our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. DrivenSystem ("we", "us", "our") provides website, automation, CRM, AI follow-up, and communication services for local businesses. You must be at least 18 years of age to use our services or opt in to SMS communications.
2. Services
We provide managed growth services including but not limited to: website design and hosting, marketing automation, CRM, review management, AI-powered follow-up, missed-call text back, and consultation calls. Specific deliverables and pricing are described in your service agreement or order form.
3. SMS Program — Description & Use Cases
The DrivenSystem SMS program sends transactional and promotional SMS/MMS text messages to users who have opted in. Use cases include:
- Appointment confirmations, reminders, and rescheduling.
- Responses to inquiries submitted through forms or chat.
- Account, service, and onboarding updates.
- Customer support replies and follow-ups.
- Occasional promotional offers and announcements (opt-in only).
4. SMS & Messaging Consent
By providing your phone number through our forms, booking widgets, chat widget, or by texting us, you agree to receive SMS messages from DrivenSystem regarding appointments, customer support, service updates, responses to your inquiry, and promotional communications. Consent is not a condition of any purchase.
SMS consent is not shared with third parties or affiliates for marketing purposes. Your mobile information and SMS opt-in consent will not be shared with third parties or affiliates for marketing or promotional purposes.
5. Message Frequency, Rates & Carrier Disclaimer
Message frequency varies based on your interaction with our services. Message and data rates may apply per your mobile carrier plan. DrivenSystem and participating wireless carriers (including but not limited to AT&T, T-Mobile, Verizon, US Cellular, Sprint, Boost, MetroPCS, Cricket, and others) are not liable for delayed, undelivered, or failed messages. Supported carriers may change without notice.
6. Opt-Out (Text STOP) & Help

7. Privacy
Our handling of personal information, including SMS opt-in data, is described in our Privacy Policy. Mobile opt-in data and consent are never shared with third parties or affiliates for marketing or promotional purposes.
8. User Responsibilities
You agree to provide accurate information, to use the services lawfully, and not to misuse our platform, infrastructure, or communications channels (including not sending spam, unlawful content, or content that violates third-party rights).
9. Payment & Billing
Fees, billing cycles, and refund terms are specified in your service agreement. Unless otherwise agreed, fees are billed in advance and are non-refundable. Late payments may result in suspension of services.
10. Intellectual Property
All content, branding, software, and materials provided by DrivenSystem remain our property or that of our licensors. You receive a limited, non-exclusive license to use deliverables for your business while your account remains in good standing.
11. Third-Party Services
Our platform integrates with third-party services (e.g., GoHighLevel, telecom carriers, payment processors). Your use of those services is governed by their respective terms.
12. Disclaimers
Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee specific business results, lead volume, or revenue outcomes.
13. Limitation of Liability
To the maximum extent permitted by law, DrivenSystem will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue. Our total liability for any claim is limited to the fees you paid us in the three (3) months preceding the claim.
14. Termination
Either party may terminate services as described in the service agreement. We may suspend or terminate access immediately for violations of these Terms or unlawful use.
15. Changes to Terms
We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms.
